Following a jury trial in the NSW Supreme Court Anthony Perish and Lawton were found guilty of murder and sentenced to 24 years and 20 years jail respectively in April Anthony's younger brother Andrew "Undies" Perish was found guilty of conspiracy to murder and sentenced to 12 years' imprisonment.
The three men are appealing their convictions in the NSW Court of Criminal Appeal on a number of grounds, including "fresh evidence" in the form of an affidavit signed by a man known for legal reasons as Witness E. Witness E was one of three men who posed as police officers and kidnapped Falconer while he was on day release at an Ingleburn smash repairer.
He was also with Anthony Perish eight years later when they were arrested at a cafe at McMahons Point. A university graduate and former army commando, Witness E was a violent criminal for many years. Andrew Perish has consistently denied any involvement in the killing of police informer Terry Falconer, who was abducted, dismembered and dumped in the Hastings River.
Today Perish was freed from prison after the parole board approved his release two weeks ago. He has been moved to a halfway house in Sydney's south-west and will be electronically monitored at all times. Perish is also banned from contacting Mr Falconer's family. Mr Perish was jailed in after he was found guilty of conspiracy to murder over the death of drug manufacturer and police informant Terry Falconer, who was abducted while on day work release from Silverwater jail on January 16, Following extensive investigations, police executed six search warrants at Ultimo, Glebe, Leumeah, Rosemeadow and Douglas Park from 5am on Wednesday.
During the searches arrested five people and seized methylamphetamine, cannabis, prescription medications, cash and electronic devices. Mr Perish was charged with several offences, including three counts of supplying prohibited drugs of a large commercial quantity and knowingly deal with proceeds of crime.
